General Terms and Conditions
1. This website is operated by Ragatz Associates, Inc. and its affiliates ("RA"). By accessing or using this website, you, as a potential advertiser for the website ("Advertiser") represent and warrant that you have the right, power and authority to agree to and be bound by the following terms and conditions, disclosures, acknowledgements and any other applicable law ("Terms and Conditions").
2. Right to Review. Advertiser remains solely responsible for the accuracy, completeness, truthfulness and content of the property advertisement. Further, Advertiser agrees to indemnify, defend, and hold harmless RA from and against any third party action, suit, claim or demand and any associated losses, expenses, damages, costs and other liabilities (including reasonable attorney's fees), arising out of or relating to Advertiser's submitted information or violation of the Terms and Conditions. RA reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by Advertiser, and in such case, Advertiser hereby agrees to cooperate with RA's defense of such claim.
3. Ownership of Posted Materials. Advertiser hereby acknowledges and represents that Advertiser owns or otherwise controls all of the rights to such content including, without limitation, all the rights and authority necessary for Advertiser to provide, post, upload, input or submit such content and that Advertiser has not infringed upon the intellectual property rights of any party by submitting and posting an advertisement on the website.
4. Prohibited Conduct. Use of profanity or discriminatory language in any section of the database is strictly prohibited. This includes the use of language that is generally considered obscene, profane, sexual, hateful, or racist in nature. Advertising or user information that includes such language will be subject to removal from the website.
5. Photographs. Advertiser acknowledges that photographs submitted for the use of the advertisements accurately depict the property for sale and the listing broker submitting such photograph acknowledges that he or she owns such photograph or has received all necessary rights and authorizations, including from the photographer and/or copyright owner of any photographs, to publish such photographs on this website.
6. Changes to Terms and Conditions. RA reserves the right, at its sole discretion, to change, modify, add or remove any portion of the Terms and Conditions, in whole or in part, at any time. Changes in the Terms and Conditions will be effective when posted and Advertiser's continued use of the website and/or services offered on or through the website after any changes to these Terms and Conditions are posted will be considered acceptance of the changes.
Disclosures & Acknowledgments
1. Advertiser acknowledges and agrees that this website is a commercial media source for sellers and buyers of real property. The proprietor of this website is not licensed as a real estate broker in any state, and all communications between buyers and sellers arising from this website must be conducted by the principals themselves or through their duly licensed agents.
2. Advertiser acknowledges and agrees that Advertiser is free to choose a broker and sales agent of his or her choice and that the name, license and contact information of such broker or sales agent shall be included in all property advertisements posted on this website.
3. All of the information and photographs included within the Ragatz Associates Resort & Hotel Showcase section of the website has been provided by advertisers, and Ragatz Associates does not assume any responsibility for the content of the information contained in the advertisements.
